Wormsley Cricket – Membership Rules and Terms & Conditions
This document sets out the Rules and Terms & Conditions applicable to Wormsley Cricket Membership (the Agreement).
It is understood and agreed that:
- a) “Wormsley Cricket Membership” is a scheme or program offered by Wormsley that allows third-party individuals to obtain and procure a Membership which grants them certain privileges to watch a number of cricket matches at Wormsley over the period that their Membership is valid
- b) For the purposes of this Agreement, “Wormsley Cricket” and “Wormsley” relates to either The Wormsley Fund and / or Wormsley Estate Limited (“Wormsley”) as a legal entity that provides and governs the “Wormsley Cricket Membership”
- c) “Members” are the third-party individuals in no way connected to Wormsley who have procured a Membership which grants them certain privileges to watch a number of cricket matches at Wormsley over the period that their Membership is valid
- d) “Founder Members” are those Members who joined the Wormsley Cricket Membership scheme prior to 2021
- e) “Member Guests” are third-party individuals who are known to the Member (“Host Member”) and who is invited by the Member to join the Member in watching cricket at Wormsley. Member Guests can only attend Wormsley with the Member, they are not permitted to attend unaccompanied by the Member
- f) “Additional Guests” are third-party individuals who are known to the Member (“Host Member”) and who may be invited in addition to the Member on a restricted basis each year
1. Wormsley Cricket Membership
Wormsley Cricket Membership in summary:
- 1.1 Wormsley offers two levels of Membership
- 1.1.1 Individual Membership: a non-transferable membership that allows the named Member to watch a minimum of ten (10) cricket matches at Wormsley over the period that their Membership is valid
- 1.1.2 Member & Guest Membership: a non-transferable membership that allows the named Member to watch a minimum of ten (10) cricket matches at Wormsley over the period that their Membership is valid, and invite one Member Guest to join them at each game.
- 1.2 There are two different types of Members:
- 1.2.1 Founder Members
- 1.2.2 Standard Members
- 1.3 The make-up of each Membership level will be as set out in the associated Application form and detailed on the Wormsley website as appropriate
- 1.4 At its sole discretion, and in giving affected Members due notice, Wormsley reserves the right to:1.4.1 restrict the number of Members in each category
1.4.2 to retire a certain Membership category, either temporarily or permanently 1.4.3 introduce new Membership categories
1.4.4 change the structure of and elements within any Membership category - 1.5 Wormsley Cricket Membership is a scheme where each individual wishing to become a Member is required to submit an Application form relating to the particular Membership category and level they wish to join
- 1.6 Wormsley reserves the right to reject any application at its total discretion, without the need or requirement to offer any associated explanation. Wormsley also reserves the right not to enter into any further communication relating to a refused application
- 1.7 An individual may make a gift of Membership to another individual on submission of the appropriate Membership Application Form (which can be requested by emailing: cricketmembership@wormsley.com)
- 1.8 It is not the intention of the scheme that either the Lifetime Membership or Annual Membership is to be treated as an Asset that can be sold or transferable to another party by any way of instruction or Will, and as such the Membership will terminate with immediate effect on the demise of said Member. Upon such demise, the terms of clause 7 will apply.
2. Compliance
- 2.1 This Agreement applies to each category and type of membership as set out above
- 2.2 Every Member agrees to comply in full with the terms of this Agreement and understandsthat as the Host Member to their Guests that they are responsible for the compliance of the Guest to the terms set out in this Agreement. To assist in such compliance, the Member isadvised to provide a copy of this Agreement to their Guest or Guests.
3. Membership Cards
- 3.1 Each Member shall receive their designated Membership cards and car passes associatedwith their Membership
- 3.2 Members must have their Membership Cards with them at every game that they attend
- 3.3 Car passes must be prominently displayed in the windscreen or on the dashboard of theirvehicle so that it is easily visible to Wormsley personnel and Stewards at all times.
- 3.4 Members are responsible for distributing the Member Guest card and car parking pass to their Guest ahead of each game that they wish the Guest to attend. The Member is responsible for retrieving the Member Guest card and car pass from their Guest at the endof each game
- 3.5 Membership cards must be shown to any Wormsley personnel (including Stewards engaged by Wormsley) upon request
- 3.6 Any Member of Member Guest who refuses to show their card or prove their identity when so requested may be asked to leave Wormsley
- 3.7 Members are responsible for reporting a lost card to Wormsley as soon as they are aware that it has been misplaced. A replacement card may be requested in writing to cricketmembership@wormsley.com specifying the circumstances of the loss. An administration fee of £10.00 will be charged for each replacement card and Wormsley reserves the right to refuse any request
4. Membership Fees
- 4.1 With the exception of the Life Membership categories which have a one-off fee attached, annual membership fees are set by Wormsley before the beginning of the calendar year to which they apply
- 4.2 Wormsley reserves the right to adjust such fees at its discretion
- 4.3 Wormsley aims to communicate the next year’s fee structure in a timely manner after theend of the season to allow Members to renew their Membership and to consider theopportunity to gift membership for the coming year
- 4.4 Membership fees must be paid before the first game that the Member wishes to attend bythe methods set out in the associated Application form
5. Cricket at Wormsley
- 5.1 Wormsley aims to provide a range of Cricket for Members to watch each year
- 5.2 Members understand that Wormsley cannot guarantee access to every game played at Wormsley each year as the approval for spectators and Members is often at the discretionof the organiser of each game
- 5.3 As such, Wormsley is not able to guarantee the number of games played at Wormsley eachyear
- 5.4 In addition, there can be factors outside of the control of Wormsley that may impact thenumber of games that can be held during any one season or that may restrict the ability of Wormsley to welcome spectators and / or Members to watch Cricket
6 Dress code and acceptable behaviour
Wormsley Cricket Membership has been established to allow lovers of the game to enjoy cricket in the beautiful surroundings of a private estate, that is the private home of the Getty Family. As such, on becoming a Member, each individual recognises and respects the surroundings, their fellow Members, the players, Wormsley personnel (including Stewards and other support staff), any other visitors attending Wormsley and the hosts of matches staged at Wormsley.
- 6.1 Dress code is ‘smart casual’. Whilst the definition of such may be open to interpretation, Members and their Guests agree not to cause offense to other attendees either by being inappropriately attired or by wearing an item (include by way of a flag or banner) that may be interpreted as offensive
- 6.2 Inappropriate behaviour and or foul or discriminatory language will not be tolerated, neither will threats to any other attendee, Guest or Wormsley personnel (including Stewards)
- 6.3 Any Member or Guest judged to be in breach of either 6.1 or 6.2 will be asked by a Wormsley personnel, by way of a verbal warning, to cease such behaviour and / or to modify their dress accordingly
- 6.4 Any Member or Guest who refuses to adhere to such warning may be ejected from Wormsley and may be subject to the conditions set out in Clause 8, Termination
7. Cancellation
- 7.1 Should an Annual Member wish to cancel their membership they may do so at any time by giving 14 days notice in writing to cricketmembership@wormsley.com
- 7.1.1 On submission of such request, the Member (and any associated Guests) will no longerbe eligible to attend Wormsley or be able to benefit from Wormsley CricketMembership
- 7.1.2 At its sole discretion Wormsley may decide to refund to the cancelling Member aproportion of their annual membership.
- 7.2 Should a Lifetime Member wish to to cancel their membership they may do so at anytime by giving notice in writing to cricketmembership@wormsley.com
7.2.1 Onsubmissionofsuchrequest,WormsleywillconfirminwritingthattheMembership will terminate at the end of the year in which the cancellation request was submitted 7.2.2 TheMember(andanyassociatedGuests)willstillbeeligibletoattendWormsleyandto benefit from Wormsley Cricket Membership until the end of that year
8 Termination
- 8.1 Wormsley may expel a Member and terminate their membership if in the opinion of Wormsley the Member’s conduct or the conduct of a Guest of the Member is deemed to be injurious to or inconsistent with the character of interests of Wormsley and Wormsley Cricket, or has been such to render them unfit to be a Member
- 8.2 Before Wormsley resolves to expel a Member, the Member concerned shall be given fair and sufficient notice of the intended action and of the general nature of the grounds relating to such action. The Member shall be afforded the opportunity of explaining their action including presenting any mitigating circumstance to defend such conduct or action either in writing to cricketmembership@wormsley.com or by appearing before a panel of Wormsley Authorised Personnel either in person or by sending a representative
- 8.3 Wormsley’s decision in relation to such matter will be final and there will be no right of appeal available to the Member
- 8.4 A Member who is expelled shall forfeit all rights in respect of any claims upon Wormsley or its property and shall cease to be a Member with immediate effect. As such, no refund of membership fees will be considered or become due.
- 8.5 An expelled Member or any Guest related to the reason for the Member to be expelled will not be considered for future membership
9 Liability
Members and Guests enter Wormsley at their own risk and Wormsley shall not be liable to the Member or any Gusts for:
- 9.1 the death or injury to the Member or his Guest(s) how so every caused while at Wormsley; or
- 9.2 the damage to or loss or theft of any property belonging to a Member or Guest
10 Cooling Off
If you change your mind after applying to join Wormsley Cricket Membership, you have a 14-day cooling-off period from either the date that your application or your membership fee is received, whichever is the later, during which time you may cancel your membership and receive a full refund of any fees paid. To be effective, you must let us know at any time during this 14-day period that you wish to cancel your membership, such notice to be submitted in writing by post or email to cricketmembership@wormsley.com.
